Back to the Future for Climate Liability


Synopsis: There is a climate policy craze sweeping the nation and it has a decidedly retro vibe - state superfunds. Vermont and New York have already passed laws holding fossil fuel producers strictly liable for the costs of adapting to and rebuilding from climate impacts. A half dozen other states seem to be right on their heels. What is the theoretical and moral imperative pushing this trend? How will these new liability schemes work? Will they withstand the inevitable barrage of industry attacks on judicial review? This lecture will try to answer these questions (and more!).
